OVERVIEW
U visas provide temporary immigration status to victims of certain qualifying crimes who have suffered substantial physical or mental harm and who are helpful to law enforcement in investigating or prosecuting the crime. To apply for a U visa, Form I‑918 and Supplement B are two essential parts of one complete petition submitted to USCIS.
OUR ROLE
The HCDAO serves as the certifying law enforcement agency for Form I‑918, Supplement B. When we receive a request for certification, we review the details to determine whether certification may be granted based on the crime involved and how the victim assisted or was helpful in detecting, investigating, or prosecuting that crime.
Please note that HCDAO does not determine whether a victim qualifies for a U visa. Certification isn’t automatic; it is issued at the discretion of the HCDAO in accordance with applicable law, USCIS guidance, and internal policies and procedures. If certification is issued, the victim or their authorized representative is responsible for submitting the U‑visa application and required documentation to USCIS.
HOW TO REQUEST CERTIFICATION
To request U Nonimmigrant Status Certification (Form I‑918, Supplement B), please complete this online form. Certification requests may be made by a victim, the victim’s immigration attorney or authorized representative, or a legal aid organization assisting the victim with their immigration matter.
